Terms of Service

1. Who We Are

Adapt Movement Lab is operated by Markus Balser, based in Düsseldorf, Germany.

These Terms of Service govern your access to and use of the Adapt Movement Lab platform, including all video content, programs, and materials available through the member area (collectively, the "Services"). By accessing the Services, you agree to be bound by these terms.

The Services are intended for users who are at least 18 years old.

2. Access and License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own private, non-commercial purposes.

Your license does not include the right to:

  • Share your account or login credentials with any other person
  • Download, record, screen-capture, or copy any video content or materials
  • Redistribute, resell, sublicense, or otherwise make the content available to third parties
  • Use the content for commercial purposes, including coaching clients, teaching classes, or creating derivative works for sale

Your access is valid for the duration of your active subscription and terminates automatically upon cancellation or non-payment.

3. Intellectual Property

All content available through the Services — including but not limited to video classes, written materials, program designs, methodologies, branding, and graphics — is the intellectual property of Markus Balser / Adapt Movement Lab and is protected by applicable copyright and intellectual property law.

Nothing in these Terms grants you any right to use our name, logo, trademarks, or content beyond the limited personal license described above.

Any unauthorized use or reproduction of our content constitutes a material breach of these Terms and may result in immediate termination of your access and legal action.

4. Health and Fitness Disclaimer

The content provided through the Services — including all movement classes, joint training programs, and educational materials — is intended for informational and educational purposes only. It does not constitute medical advice, diagnosis, or treatment.

You acknowledge and agree that:

  • Movement and exercise carry inherent risk of injury. You participate entirely at your own risk.
  • You should consult a qualified medical professional before starting any new exercise or movement program, particularly if you have any existing health conditions, injuries, or physical limitations.
  • We make no representations or warranties that any specific result or outcome will be achieved through the use of our content.
  • We are not liable for any injury, health complication, or damage arising from your use of the Services or your application of any technique, program, or method presented in our content.

By accessing the Services, you confirm that you are physically capable of participating in movement training, or that you have obtained appropriate medical clearance to do so.

5. Payment and Subscriptions

Payments for membership are processed by Copecart GmbH, which acts as Merchant of Record for all transactions. When you purchase a membership, you enter into a purchase agreement with Copecart, subject to Copecart's own Terms and Conditions. We are not a party to that transaction.

Subscriptions renew automatically unless cancelled before the end of the current billing period. You can manage and cancel your subscription directly through your account.

6. Account and Termination

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate your access to the Services at any time, without notice, if we reasonably determine that you have:

  • Violated any provision of these Terms
  • Shared your account or credentials with others
  • Reproduced or redistributed any content without authorization
  • Used the Services in any unlawful or abusive manner

Termination does not entitle you to a refund for any remaining subscription period.

7. Prohibited Conduct

When using the Services, you agree not to:

  • Access or attempt to access another user's account
  • Interfere with or disrupt the functionality of the platform or its infrastructure
  • Use the Services for any unlawful purpose
  • Attempt to reverse engineer, scrape, or copy any part of the platform or its content
  • Misrepresent your identity or affiliation

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content. We do not guarantee uninterrupted or error-free access to the Services.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Markus Balser / Adapt Movement Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.

Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you to Copecart for your subscription in the six months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you are a consumer resident in the EU, you also benefit from any mandatory consumer protection provisions of the law in your country of residence.

Both parties submit to the non-exclusive jurisdiction of the courts of Düsseldorf, Germany, for the resolution of any disputes arising under these Terms. EU-resident consumers may also bring claims in their country of residence.

11. Dispute Resolution

The European Commission provides an online dispute resolution platform for consumers, accessible at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings but are willing to consider them on a case-by-case basis.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
